Court: reaffirms that muddy water is pollution

GRANTS PASS, Ore. (AP) — A federal appeals court has reaffirmed that muddy water running off logging roads after rainstorms is pollution that requires a special permit from the U.S. Environmental Protection Agency.
The Oregon Department of Forestry and some timber companies had asked the 9th U.S. Circuit Court of Appeals to reconsider its ruling from August, and on Tuesday the court said it would let the original ruling stand.
Chris Winter of the Crag Law Center in Portland says logging roads are one of the leading sources of pollution harming salmon and steelhead across the West, and he hopes this ruling will lead to improvements on state, federal and private timberlands.
Rod Nichols of the Oregon Department of Forestry says the agency will have no comment until it fully reviews the decision.
